I. Call To Order Chair Olsen called the meeting to order at 7:00 P.M. II. Roll Call Answering the Roll were: Chair Olsen, Commissioners Hobbs, Strauss, Nemerov, Hamilton, Bennett Berube. Student Members, Kivimaki and Jones. City Planner Teague, Assistant Planner, Aaker, Support Staff Hoogenakker Absent from the Roll: Thorsen. III. Approval Of Meeting Agenda A motion was made by Commissioner Strauss to approve the December 14, 2016, meeting agenda. The motion was seconded by Commissioner Lee. All voted aye. The motion carried. IV. Approval Of Meeting Minutes A motion was made by Commissioner Strauss to approve the November 9, 2016, Meeting minutes. The motion was seconded by Commissioner Hobbs. Commissioner Nemerov offered a change. All voted aye. The motion carried. V. Public Hearings A. B-17-17. Side Yard Setback Variance Request. 4132 45th Street West, Edina, MN Planner Presentation Planner Aaker presented her staff report for a 2-foot side yard setback variance to allow an air conditioning unit to remain in its present location. Aaker concluded that staff recommends approval of the variance based on the following findings: Page 1 of 5 Draft Minutest Approved Minutes® Approved Date: I/1 1/2017 • With the exception of the variance requested, the proposal would meet the required standards and ordinances for the R-I, Single Dwelling Unit District. • The proposal would meet the required standards for a variance because the proposed use of the property is reasonable; as it alters conditions on the property only slightly and keeps the air conditioning unit away from neighboring homes. • The practical difficulty is imposed by the lot size, driveway location and home configuration limiting AC location opportunity. The intent of the ordinance is to provide adequate spacing between neighboring homes. Spacing will be adequately maintained. Aaker concluded that the site must be developed and maintained in substantial conformance with the following plans, unless modified by the conditions: Survey date stamped October 26, 2016 and building plans and elevations date stamped October 26, 2016. Appearing for Applicant Dean Jones and Ami Sharp, applicants and property owners. Discussion/Comments Planner Aaker was asked if a house were adjacent to the subject site and not a City park would staff feel differently about the setback provided by the air conditioning unit. Planner Aaker responded in the affirmative. She said the placement of the new air conditioning unit makes sense because of the adjacent park. She stated if another house were adjacent she would not support the request. She noted the current location minimizes impact on the neighboring homes; albeit it does abut a City park. Commissioners commented that the request seems reasonable; noting the air conditioning unit was installed prior to variance approval. Applicant Presentation Mr.Jones addressed the Commission and reported that the air conditioning unit could be located in a conforming location; however, the neighbor to the rear would be impacted. Ms. Sharp also informed Commissioners that the air conditioning unit would be screened from park property. Public Hearing Chair Olsen opened the public hearing. No one spoke to the issue. A motion was made by Commissioner Hamilton to close the public hearing. The second was offered by Commissioner Strauss. All voted aye. The public hearing period was closed. Page 2 of 5 Draft Minutes❑ Approved Minutes® Approved Date: I/1 1/2017 Discussion Commissioners were in agreement that the proposed location of the air conditioning unit made the most sense and they would support the variance with the condition that the unit is screened as indicated. Motion A motion was made by Commissioner Hamilton to approve the variance request based on staff findings and subject to the staff conditions. A second was offered by Commissioner Strauss. All voted aye. The motion carried. B. B-16-18. Setback Variance Request. 4703 Golf Terrace, Edina, MN. Planner Presentation Planner Aaker presented the staff report noting that staff recommends approval of the 6.2-foot side yard setback variance from the east property line to extend the existing garage 2-feet closer to the side lot line for 4703 Golf Terrace. Aaker concluded that approval is based on the following findings: • With the exception of the variance requested, the proposal would meet the required standards and ordinances for the R-I, Single Dwelling Unit District. • The proposed use of the property is reasonable as it alters conditions on the property only slightly and keeps the garage addition within a reasonable distance from the side yard. • The practical difficulty imposed by the setback and the nonconforming garage location limits design opportunity. The intent of the ordinance is to provide adequate spacing between structures. Spacing to the next door neighbor will be adequately maintained. Aaker further noted that approval is condition upon a survey dated stamped November 18, 2016 and building plans and elevations date stamped November 18, 2016. Appearing for the Application Jeffrey and Dawn Hillins Discussion and Comments Commissioners asked staff if the City of Edina had a standard size for a "two stall" garage. Planner Aaker responded a "standard" has not been established; however, any two stall garage under 22-feet in width is Page 3 of 5 Draft Minutes❑ Approved Minutes® Approved Date: I/1 1/2017 undersized. Aaker further noted that the variance requested is a typical request.; especially in the older home areas and the change in size of vehicles. Commissioners acknowledged the width of the current garage can present problems in opening and closing vehicle doors. An opinion was expressed that the addition is minimal in scope and scale and the addition retains the limestone. It was acknowledged that the addition was better than tearing down and starting over. Commissioners further stated that they would like to have the applicant engage an arborist to ensure the safety of the tree stand (Red Cedar) during construction. Motion A Motion as made by Commissioner Hamilton to approve the variance based on staff findings and subject to staff conditions to include as an additional condition that careful attention be paid to protect the trees. The motion was seconded by Commissioner Hobbs. All voted aye. The motion carried. VI. Community Comment None. A motion was made by Commissioner Hobbs to closed Community Comment. The motion was seconded by Commissioner Strauss. All voted aye. The motion carried. VII. Reports/Recommendations None. VIII.Correspondence And Petitions Chair Olsen acknowledged back of packet materials. IX. Chair And Member Comments Chair Olsen reported that the Planning Commission unanimously selected a consultant firm for the 2018 Comprehensive Plan update. Olsen said the firm would be announced after the first of the year. X. Staff Comments Planner Teague wished everyone a Happy New Year!
