BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows: City Of Edina Section 1. BACKGROUND. 1.01 The applicant is requesting a Conditional Use Permit to tear down and construct a new home at 4509 Garrison Lane. A Conditional Use Permit is requested to allow the first floor elevation of the new home to exceed the first floor elevation of the existing home by more than one foot. Specifically the applicant would like to raise the first floor elevation 2.4 feet above the existing first floor elevation. 1.02 The property is legally described as follows: Lot 7, Block 2, MILLER'S ADDITION,Hennepin County,Minnesota. 1.03 On March 23,2011, the Planning Commission recommended approval of the conditional use permit. Vote: 6 Ayes and 0 Nays. Section 2. FINDINGS • 2.01 Approval is based on the following findings: 1. The proposal meets the Conditional Use Permit conditions per Section 850.04 Subd. 5.E,of the Edina Zoning Ordinance. 2. Per Section 850.11.Subd.2, of the Edina Zoning Ordinance,one or more of the first three conditions listed, and always condition four must be met. Conditions#2 and #4 are found to be met. 3. The proposal meets all applicable Zoning Ordinance requirements. 4. The proposed new home is in character with this neighborhood in height,mass and scale. Section 3. APPROVAL NOW THEREFORE,it is hereby resolved by the City Council of the City of Edina, approves the Conditional Use Permit to allow construction of a new home at 4509 Garrison Lane,subject to the following conditions: 1. The site must be developed and maintained in conformance with the following plans: • • Survey date stamped March 9,2011. • Building plans and elevations date stamped March 9, 2011. Submit a copy of the Nine Mile Creek Watershed District permit. The City may require revisions to the approved plans to meet the district's requirements. 3.
