HomeMy WebLinkAboutResolution No. 2017-016 6124 Ewing Prelim & Final Plat e - v .2y i�Hr RESOLUTION NO.2017-16 APPROVING A PRELIMINARY&FINAL PLAT WITH VARIANCES AT 6124 EWING AVENUE BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows: Section 1. BACKGROUND. 1.01 Jacob Steen,on behalf of 6124 Ewing LLC is proposing to subdivide the property at 6124 Ewing Avenue into two lots. 1.02 The existing home and garage would be removed. 1.03 Within this neighborhood,the median lot area is 11,500 square feet,median lot depth is 135 feet,and the median lot width is 81.5. 1.04 The following described tract of land is requested to be divided: Lot 3, Block 1 Engelhart Addition,Hennepin County, Minnesota. 1.05 The owner of the described land desires to subdivide said tract in to the following described new and separate parcels (herein called"parcels') described as follows: Lots 1 and 2,Block 1, Engelhart Addition Replat. 1.06 To accommodate the request the following is required: 1. A subdivision; 2. Lot width variances from 81.5 feet to 76 feet for each lot;and 3. Lot area variances from 11,500 square feet to 11,172 square feet for each lot. 1.07 The Subject Property is guided Single Family Residential under the City's Comprehensive Plan and is zoned R-1,Single Dwelling Unit District. 1.08 Previous property owners of this site have sold off small portions of land to the adjoining lots. In 1990, a (5)foot by 147 foot strip (735 square feet) was deeded to the property to the south. In 2012, an eight (8)foot by 147 foot strip (1,176 square feet) was deeded to the property to the north. If these two strips of land were not added to the adjacent lots,there would be no need for variances with this proposed subdivision. The original lot was 165 feet wide. Fax 952-826-0389 Resolution No. 2017-16 Page 2 1.09 On January 25, 2017, the Planning Commission recommended approval of the preliminary plat,subdivision and variances. Vote: 8 Ayes and 0 Nays. 1.10 On February 22, 2016, the City Council held a public hearing on the proposed subdivision and variances. Section 2. FINDINGS 2.01 Approval is based on the following findings: 1. Except for the variances, the proposal meets the required standards and ordinance for a subdivision. 2. The original lot was platted to be 165 feet wide. In 1990,a five (5) foot by 147 foot strip (735 square feet)was deeded to the property to the south. In 2012, an eight(8)foot by 147 foot strip (1,176 square feet)was deeded to the property to the north. If these two strips of land were not added to the adjacent lots, there would be no need for variances with this proposed subdivision. 3. The proposed lots would be similar in size to all other lots on the 6100 block of Ewing Avenue. 4. The proposal meets the required standards for a variance,because: a. There is a unique practical difficulty to the property caused by actions of a previous property owner that sold off portions of the subject property to adjacent land owners. If that property were not sold off,no variances would be required, and applicant would be entitled to the subdivision. b. The requested variances are reasonable in the context of the immediate neighborhood. The existing lot is both larger and wider than most properties in the area,including the adjacent lots to the east,west and south.The proposed subdivision would result in two lots more characteristic of the neighborhood. c. The variances would meet the intent of the ordinance because the proposed lots are of similar size to others in the neighborhood. Section 3. APPROVAL NOW THEREFORE,it is hereby resolved by the City Council of the City of Edina,approves the Preliminary&Final Plat and Lot Area and Width Variances for the proposed subdivision of 6124 Ewing Avenue. Approval is subject to the following Conditions: 1. Prior to the filing of the Plat,the existing home must be removed from the site. Resolution No. 2017-16 Page 3 2. Prior to issuance of a building permit,the following items must be submitted: a. Submit evidence of Minnehaha Creek Watershed District approval. The City may require revisions to the preliminary plat to meet the district's requirements. b. A curb-cut permit must be obtained from the Edina engineering department. c. A grading,drainage and erosion control plan subject to review and approval of the city engineer. The proposed plans shall meet all conditions outlined in the engineering memo dated January 18,2017 d. There shall be no increase in peak rate or volume to neighboring private property. e. Any disturbance to the roadway caused by the construction of the new homes must be repaired by replacing the asphalt pavement from curb-to-curb and from saw-cut to saw-cut. f. A construction management plan will be required for the construction of the new homes. g. Utility hook-ups are subject to review of the city engineer.
