HomeMy WebLinkAboutResolution No. 2008-113 CUP Easement Vacation for Interlachen Country Club • RESOLUTION NO. 2008-113 APPROVING CONDITIONAL USE PERMIT AT 6200 INTERLACHEN BOULEVARD AND GRANTING THE VACATION OF PUBLIC RIGHT-OF-WAY BELMORE LANE WHEREAS, a motion of the City Council, on the September 16, 2008, fixed a(late for a public hearing on a proposed vacation of utility easements; and • WHEREAS, two weeks published and posted notice of said hearing was given and the hearing was held on November 3, 2008, at which time all persons desiring to be heard were given in opportunity to be heard thereon; and WHEREAS, the Council deems it to be in the best interest of the City and of the public that said vacation be made; and WHEREAS, the Council considered the extent the vacation affects existing easements within the area of the vacation and the extent to which the vacation affects the authority of any persons, corporation, or municipality owning or controlling electric, telephone or cable television poles and lines, gas and sewer lines, or water pipes, mains and hydrants on or under the area of the proposed vacation to continue maintaining the same, or to enter upon such casement area or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; and WHEREAS, the friterlacheii Country Club ("Applicant") is requesting a Conditional Use Perinit to expand the Interlachen Golf Course and build two new maintenance buildings. Two existing single-family homes would be torn down, and Belmore Lane would be shortened to accommodate the request; and WHEREAS, on October 1, 2008, the Planning Commission recommended approval of the request; and • 14205 1 vO I RNK:10/31/2008 WHEREAS, the City Council finds the proposal meets the Conditional Use Permit conditions per Section 850.04 Subd. 4. E, of the Edina Zoning Ordinance and the proposal meets all applicable Zoning Ordinance requirements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin C01.111ty, Minnesota: 1. The following described public alley right-of-way easements are hereby vacated conditioned Up011 the Applicant first relocating the existing public and private utilities Out of the vacate easement area at the Applicant's expense to locations satisfactory to the owners of the utilities: That part of Beirriore Lane, originally dedicated as Seth Avenue in the recorded plat of Mendelssolin, Hennepin County, Minnesota, and now be vacated, which lies easterly of the southerly extension of the west line of Lot 1, Wilhoit's Addition , according to the recorded plat thereof, Hennepin County, Minnesota. 2. A Conditional Use Peri-nit to expand the Interlachen Golf Course at 6200 Interlachen Boulevard legally described on the attached Exhibit A. ("Subject Property") is approved subject to the following conditions: • Approval is subject to the following conditions: A. The site nest be developed and maintained in.substantial compliance with the following plans, unless modified by the conditions below: • Site plan date stamped October 30,2008. • Building elevations date stamped October 30, 2008. • Grading plan date stamped October 30,2008. • Landscape plan date stamped October 30, 2008. • Cul-de-sac reconstruction plan date stamped October 30, 2008. B. The City Council must approve the Vacation of the end of Belmore Line. C. Submit copy of the Minnehaha Creek Watershed District Permit. The City will require revisions to the approved plans to meet the District's requirements. D. The Behnore Lane cul-de-sac must be re-designed and reconstructed by the applicant per city standards. Final re-construction plans shall be subject to review and approval of the city engineer. E. Access from.Belmore Lane shall be used by emergency vehicles only.The gate located at the entrance to the site shall remain locked., and not be used by members or employees of the club. • 142051 vO 1 2 RNK:10,131/2008 • F. Belmore Lane play not be used by construction vehicles accessing the site,or for parking. G. The buildings inust meet all applicable building permit requirements. FT. All conditions required by the city engineer in his memo dated September 25,2008. 1. Record the approving resolution with the county. J. All conditions listed in the letter from the Belinoro Neighborhood Association dated September 25,2008, that are not in conflict with the above conditions. (Page A4'1 of the staff report.)
