HomeMy WebLinkAboutResolution No. 2007-073 Lot Division - Best Buy Site, 3201/3101 West 69th St RESOLUTION NO. 2007-73 w9iNA, APPROVING A LOT DIVISION FOR o @ 3201 AND 3101 m WEST 69TH STREET w City Of Edina WHEREAS, the following described tracts of land constitute two separate parcels: DESCRIPTION OF PROPERTY SURVEYED That part of the North 200 feet of Tract M, REGISTERED LAND SURVEY NO. 629. Hennepin County. Minnesota lying West of the East 347 feet thereof,and that part of the West 310 feet of said Tract M lying North of the South 196 feet thereof except that part' thereof lying West of the West line of the East 347 feet of said Tract M. (Per Certificate of Title Certificate Number 11442277) And That part of Tract M. REISTERED LAND SURVEY NO. 629. Hennepin County. Minnesota lying North of the South 196 feet and lying East of the West 310 feet thereof. Subject to a drainage and utility easement over the North 20 feet of above land as shown in deed Doc. No. 960897. (Per Certificate of Title Certificate Number 11 79405) WHEREAS, the owners of the described land desire to subdivide and combine said tracts in to the following described new and separate parcels (herein called "parcels") described as follows: TRACT A: That part of Tract M, Registered Land Survey No. 629, Hennepin County, Minnesota lying • north of the south 196.00 feet of said Tract M and west of a line described as commencing at the northeast corner of said Tract M; thence South 89 degrees 54 minutes 25 seconds West assumed bearing along the north line of said Tract M a distance of 216.44 feet; thence on a bearing of South a distance of 175.03 feet; thence on a bearing of West a distance of 35.61 feet; thence on a bearing of South a distance of 92.50 feet; thence on a bearing of East a distance of 13.67 feet; thence on a bearing of South a distance of 46.67 feet; thence on a bearing of West a distance of 9.83 feet; thence on a bearing of South a distance of 41.58 feet to the north line of said south 196.00 feet of Tract M and said line there terminating. EXCEPT that part of said Tract M lying south of the north 200.00 feet and west of the east 347.00 feet of said Tract M. TRACT B: That part of Tract M, Registered Land Survey No. 629, Hennepin County, Minnesota lying north of the south 196.00 feet of said Tract M and east of a line described as commencing at the northeast corner of said Tract M; thence South 88 degrees 54 minutes 25 seconds West assumed bearing along the north line of said Tract M a distance of 216.44 feet; thence on a bearing of South a distance of 175.03 feet; thence on a bearing of West a distance of 35.61 feet; thence on a bearing of South a distance of 92.50 feet; thence on a bearing of East o distance of 13.67 feet; thence on a bearing of South a distance of 46.67 feet; thence on a bearing of West a distance of 9.83 feet; thence on a bearing of South a distance of 41.58 feet to the north line of said south 196.00 feet of Tract M and said line there terminating. WHEREAS, the requested subdivision is authorized under Code Section 810 and it has been determined that compliance with the Subdivision and Zoning Regulations of the City of Edina will create an unnecessary hardship and said newly created Parcels as separate tracts of land do not City Hall 952-927-8861 4801 WEST 50TH STREET FAX 952-826-0390 EDINA,MINNESOTA, 55424-1394 www.cityofedina.com TTY 952-826-0379 RESOLUTION NO. 2007-73 Page Two interfere with the Subdivision and Zoning Regulations as contained in the Edina City Code Sections 810 and 850; NOW THEREFORE, it is hereby resolved by the City Council of the City of Edina, that the conveyance and ownership of the above described tracts of land (PARCEL A and PARCEL B) as separate tracts of land are hereby approved and the requirements and provisions of Code Sections 850 and 81-are hereby waived to allow said division and conveyance thereof as separate tracts of land but only to the extent permitted under Code Sections 810 and 850 subject to the limitations set out in Code Section 850 and said Ordinances are now waived for any other purpose or as to any other provisions thereof, and further subject, however, to the provision that no further subdivision be made of said Parcels unless made in compliance with the pertinent Ordinances of the City of Edina.
