RESOLUTION NO. 2017-113
VACATING SANITARY SEWER EASEMENT AT THEr—
SOUTHWEST CORNER OF THE SOUTHDALE CENTER PROPERTY
WHEREAS, a petition was received on July I I, 2017, from the property owner of Restoration Hardware, 15
Koch Road, Suite K, Corte Madera, CA 94925, who owns the property at the southwest corner of the Southdale Center
property, dedicated as Tract B, Registered Land Survey No. 1849, requesting that it be vacated; and
WHEREAS, two weeks published and posted notice was given and the hearing was held on October 17, 2017,
at which time all persons desiring to be heard were given an opportunity to be heard thereon; and
WHEREAS, the City Council deems it to be in the best interest of the City and of the public that said vacation
be made; and
WHEREAS, the City Council has determined that the easement is not needed for public purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin County,
Minnesota:
I. That the following described sanitary sewer easement is hereby vacated:
That part of the Sanitary Sewer Easements per Document Numbers 693941 and 3424125
embraced within Tract B, REGISTERED LAND SURVEY NO. 1849, files of the Registrar of Titles,
Hennepin County, Minnesota, and all of the Sanitary Sewer Easement per Document Number
595304.

2. The vacation shall not affect the authority of any person, corporation, or municipality owning or controlling
the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or
thereunder, if any, to continue maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove, or otherwise attend thereto.
3, That the Mayor and the City Manager are authorized to execute all documents necessary, in the opinion of
the City Attorney, to effect the transfer of this property.
