BE IT RESOLVED by the City Council of the City of Bina. Mjiiac,s:�Aa (the "City"), as follows
WHEREAS, pursuant to Minnesota Statutes, Sections 469.124 to 469.134, th,- (:`*
Council on .April 2, 1990 adapted the Development. Program for Development District No. 2 (the
"Ueveh)prr. .nt Program")'. which created a do w�iopm,7.tt district in the City designated as
Devclopnieat District No. 2 (the "District"),,
WHEREAS, it is necessary, adv.sable, and in the public interest that the City, acquire for
redev?iopnient purposes, a.r..d nnrs�lhrrt r`i th'. De ,clop.re.nt Program, propert_r within the
I::tevu_opme rt:District;. and
Vi"HE,REAS, in order to assist lir the reaevel pment of the property in the Developmen!
District in accordance with the Devclopmc:it: Y"rog arr,, it. is necessary that the pTOJ ernes

Program and provide for the redev,eloprnen.i r,f the property described wi Exhibit A hFcieO in a.
manner that would meet the objectives and purposes of the Developrnient Program, the City
proc.-ed to acquire the property described on Fxhib,t A hereto and all interests triere , under its
power �, 'eminent domain; and that the attorneys for the City be instructed and directed %o Erie the
necessary petition or petitions therefor and to prosecute si_,ch act.on or actions to .a. successful
conclusion., or until it is abandoned, dismissed or terminated by the City or the Court; anr3 that
the attorneys for the City, and the officers of t1he ('its- do all things necessary to bc, dont in the
commencement,prosecution and successful ten-nina.ion of such eminent domain proceedings.
BE IT FURTHER RI?SOLVED, that it is hereby found and declared that the acquisiticl)
of th.e;property described on Exhibit .A hereto and all interests therein by the City under its power
of eminent domain is necessary to rede�,elop property in the Development District in accordance
with the Development Program.
