RESOLUTION NO. 2018-10 VACATING PORTION OF GLENHURST AVENUE WHEREAS, a petition was received on July 6, 2017, from the property owner of 4000 42nd Street West, who owns the property abutting Glenhurst Avenue, dedicated in the plat of Morningside Manor Addition, Morningside, Minnesota, requesting that it be vacated; and WHEREAS, two weeks published and posted notice was given and the hearing was held on January 3, 2018, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the City Council deems it to be in the best interest of the City and of the public that said vacation be made contingent on 3912 and 4000 42nd Street West dedicating new public and private easements; and WHEREAS, the City Council has determined that the right-of-way is not needed for public purposes; and WHEREAS, the following described right-of-way is hereby vacated subject to conveyance, to the city, of drainage and utility easements that are approved by the city engineer; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin County, Minnesota: I. That the following described right-of-way is hereby vacated: That part of Glenhurst Avenue being 50 feet in width, as dedicated in the recorded plat of MORNINGSIDE MANOR ADDITION, Hennepin County, Minnesota lying north of a line between the southeast corner of Lot 2, Block I, and the southwest corner of Lot I, Block 2 and south of a line between the northeast corner of Lot 2, Block I and the northwest corner of Lot I, Block 2 said MORNINGSIDE MANOR. 2. The vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, if any, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto, 3. That the property owners at 3912 and 4000 42nd Street West execute the public and private utility easements, 4. That the Mayor and the City Manager are authorized to execute all documents necessary, in the opinion of the City Attorney, to affect the transfer of this property.
