HomeMy WebLinkAboutResolution No. 2018-065 Conditional Use Permit Life Time 250 Southdale Center RESOLUTION NO. 2018-65 APPROVING A CONDITIONAL USE PERMIT FOR LIFE TIME ATHLETIC AT 250 SOUTHDALE CENTER BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows: Section 1. BACKGROUND. 1.01 Life Time Athletic is proposing rooftop dining at the building under construction at 250 Southdale Center, the former site of J.C. Penney at Southdale Center. A site plan for Life Time and an adjacent multi-tenant building were reviewed and administratively approved by planning staff. A footing and foundation permit was issued on June 18, 2018 and a second building permit for the remainder of the work is under review. The proposed rooftop restaurant would be utilized by Life Time Athletic members and guests. 1.02 The property is legally described as follows: Tract B of Registered Land Survey No. 1858, according to the plat thereof on file and of Record in the Office of the Registrar of Titles in and for said Hennepin County, Minnesota 1.03 To accommodate the request, the following land use applications are requested: 1. A Conditional Use Permit. 1.04 On June 27, 2018, the Planning Commission unanimously recommended approval of the request. 1.05 On July 17, 2018 the City Council held a public hearing on the Conditional Use Permit. Section 2. FINDINGS 2.01 Approval is based on the following findings: 1. The proposed rooftop dining is not in close proximity to existing residential uses. 2. The proposal meets the conditional use permit criteria in Section 36-612 of the City Code. APPROVAL NOW THEREFORE, it is hereby resolved by the City Council of the City of Edina, approves the Conditional Use Permit for Life Time Athletic at 250 Southdale Center. Approval is subject to the following conditions: I. Hours of operation are limited to 7:00 am to 10:00 pm. 2. Amplified sound shall be subject to the city's noise ordinance chapter 23, division 5 of the city code. 3. The rooftop dining area will be kept in a clean and orderly manner. 4. A liquor license is required to serve alcohol. 5. Required fencing shall meet the Minnesota State Building Code and must be reviewed and approved by the Building Department at the time of building permit. 6. Lighting shall meet the requirements in Section 36-1260 of City Code. 7. The rooftop dining area shall be constructed per the plans date stamped May 14, 2018 Adopted by the city council of the City of Edina, Minnesota, on July 17, 2018.
