AT THE EDINA VILLAGE HALL Members Bredesen, Child, Danens, Bank and Erickson answered Rollcal.l. Messrs. Harold Utley and Ralph Johnson of the Citizens Committee on the \ New Village Hall reported that American Legion Post #471 Housing Foundation, Inc. will not accept the offer made by the Village Council at their meeting of April 27; that Legion wishes to be sure of parking privileges. They presented a plan wher.eby the Legion will deed to the Village the two tracts of land needed for the new Village Hall, the Village will deed to the Legion the small tract of land covering Legion Hall encroachment on Village property; and the Village will deed to the Legion a forty- footstrip of property abutting the presently owned Legion property on the East and extending from Eden Avenue northerly to the Northeast corner of that property owned by the Legion after conveyance to the Village of the two tracts cited above --- with this latter deed to contain a restriction that said forty -foot strip is to be used for parking purposes only and that if used for other purposes is to revert to the Village of Edina. Childs motion, that this plan be approved, and that Village Manager be authorized to inform the Legion by letter of Council's intent, was seconded by Danens and carried. After a thorough inspection and analysis of the subject property, it is my opinion that the market value of this property in its present condition as of October 22„ 19512 was $283,000, distributed $22,000. to the 4.22 acre tract and $6,000. to the one acre tract. This is the price at which, in may opinion, you would be justified in buying the subject property under present market conditions. F4S -44 FIRST NATIONAL BANK OF MINNEAPOLIS Village of Edina -2- October 24, 1951 The value reported is subject to zoning permitting commercial use and release of present deed restrictions which limit the property to school and church use. it is believed that the highest, best and most profitable use of subject land would be for commercial retail stores. Another good use of the land would be a civic center develop- ment containing such improvements as a village hall, fire and police stations, library and recreation center. The proposed channelization of roads at the intersection of Highways 100, 169, and West 50th Street was examined and it is believed that this will not impair the subject land for commercial,, civic, or open development uses. The property appraised is shown on the attached sketch shaded in blue and corresponds to the legal descriptions given above. That portion shaded in green is now owned by the Village of Edina and Lots 10 and 11, Block 5, Craiks First Addition, are owned by the Edina American Legion. JLN M Very truly yours, James L. Nye E. In regard to your exchanging properties with the American Legion, we advise you that it is our opinion that the Village can convey out property without vote of the electors but they must receive the best possible price. In this case, we can see no question involved. We suggest you exchange deeds with the American Legion in the manner which you proposed to us. We call your attention, however, to the description used in the deed from the American Legion to the Village. The first word in the last line of the description should be "West'"rather than "East". We return herewith the two proposed deeds which you sent to us in your letter of March 26th. We call to your attention that before the American Legion can record the deed which you are giving them, it will be necessary for a registered land survey to be prepared and filed with the Reg- istrar of Titles inasmuch as this is a conveyance of registered land which is not described as "a full government subdivision or simple fractional or quantity part of a full government subdivision't. We enclose herewith a booklet from the office of the Register of Deeds and we refer you to pages 6 and 7 thereof. This may be helpful to you in the event you decide to prepare and file a registered land survey to permit the American Legion to record their deed. In the event you do decide to make a registered land survey,, I would suggest that you show all your registered property thereon with one lot being the Church property after having deducted the part conveyed to the American Legion; show the part conveyed to the American Legion as Lot 2, and the school property, using the description here inabove set forth in this letter, as Lot 3.
