a corporation under the laws of7he rtRe of Minnesota, party of the first part,
and VILLAGE OF EDINA, a lfUNICIPAL corporation under the laws of the State of Minne-
sota, party of the secorx part,
WITNESSETH, That the said party of the first part, in consideration of the
sum of ONE DOLLAR AND OTHER GOOD AND VALUABLE CONSIDERATION, to it in hand paid
by the said party of the second part',* "the receipt whereof is hereby acknowledged,
does hereby Grant, Bargain anal 6nvey unto the said party of the second part, its
successors and assigns, forever, an easement for the construction, repair and main-
tenance of a storm sewer over and upon the parcel of land lying and being in the
County of Hennepin, State of Minnesota, described as follows, to -wit:
The East Five (5) feet of the North one-half (Nz) of the West
Forty (40) feet of Lot Thirty -six (36), Auditorts subdivision
One Hundred Seventy -two (172), Hennepin County, Minnesota; and
the Grantee herein by the acceptance and use of said easement
does covenant to the Grantor, its successors and assign*, that
it will indemnify Grantor, or its successors and assigns, for
any loss or damage resulting to any portion of the above.des-
cribed tract of land, other than the portion covered bytsis
easement, or to any buildings or structures on said traA of
land, other than the portion covered by this easement, arising
out of the use by Grantee of said easement, and the'Gragtee
further covenants that it shall in the construction.,' mainena-
ance and repair of said storm sewer, replace, the surface of
the ground including sod, shrubs and trees to as nearly as
possible the sane condition as existed prior to such construct-
ion, maintenance or repair.
