Village of Edina and unto its successors and assigns until January It 1956.
The parties of the first part do hereby covenant with the Village
of Edina that they are lawfully seized and possessed of the real estate
above described; that they have a good and lawful right to convey itq or
arq part thereof; that it is free from all encumbrances; and that they
will forever warrant and defend the title thereto against the lawful
claims of the persons whomsoever.

WITNESSETH$ That for and in consideration of the sum of One
Dollar {61.00} and other good and valuable consideration.. cash in hand
paidj, the receipt of which is hereby acknowledgedt the parties of the
first part have this day bargained and sold., and by these presents do
bargain, sell.. convey' transfer,, and deliver unto the Village of Edina.,
an easement and right- of -wayp including the right to enter upon the real
estate hereinafter described, at any time that trunk sewer N** 69 is
in process of construction but not later than January 1, 1956: for the

deposit upon said lands all dirt., stones, boulders.. sand and gravel
which shall be necessary or incidental to the construction of said
