THIS INSTRUMENT, Trade this 5th day of l'o er —19_9U by and

between and YArgit Harrison Rusband
and We 0 of the County of Hennepin and State of Minnesota,
parties of the first part,# and the Village of Edina,, a municipal
corporation of the County of Hennepin and State of Minnesota., party
of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and no/100 (1.00) Dollars, to them in hand paid
by the said party of the second part., the receipt whereof is hereby
acknowledged' do Grant$ Bargain., Sell and Convey to said party of the
second part an Easement for the purposes hereinafter set forthp in and
over the following described property situated in the Village of Edina„
County of Hennepin and State of Minnesota, to wits
But 3.33 feet of west 658 «5 feet of south 170 feet of north 438 feet of
H'.W. 1 /4 of E.E.:LAO Sea. 302 T. 28N*s R. 24Wos except that portion

The south 8 feet of above described parcel extending frox the Solio
corner west to the east fine of Garrison Leese and the east 9 feet of
the south 104 feet of abm described parcel.
This Easement fcr sanitary sewer purposes only„
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utilities, replace the surface after any excavation in connection
with such construction or maintenance work"in as nearly as possible the
same condition as before such excavation)' and it is a condition of this
easement that said restoration of the surface shall be done within a
reasonable time after any excavating and in all events shall be completed
within sixty days after such excavation work is begun.
The duration of this easement shall be perpetual.
It is also agreed that drain field whieh is losated on the aboTo
doseribed easement, will be resonstrnetod by party of the seeond
part in a manner eoapletely satisfastory and at no expense to
party of the first part.
