Stocke: and Thelma S. Stocke, of Hennepin County, Minnesota, partLew6fthe first part,
and VILLAGE OF EDINA, a MUNICIPAL corporation under the laws of the State of Minne-
sota, party of the second part,
WITNESSETI?, That the said partjkes of the first part, in consideration of the
sum of ONE DOLLAR �'D OTHER GOOD AND VALUABLE CONSIDERATION, to them in hand paid by
the said party of the second part, the receipt whereof is hereby acknowledged, do
hereby Grant, Bargain and Convey unto the said party of the second part, its suc-
cessors and assigns, forever, an easement for the construction, repair and mainten=
ance of a storm sewer over and upon the parcel of land lying and being in the
County of Hennepin, State of Minnesota, described as follows, to wit:
The South five (5) feet of Lot Five (5), Block Two (2), Stocke &
Hanson Concord Terrace, Hennepin County, Minnesota; and the Grantee
herein btu the coeptance and use of said easement does covenant to the
Grantor�,their!Wcdssors and assigns, that it will indemnify Grantors;
or their heirs, successors and assigns, for any loss or damage resulting
to any portion of the above described tract of land, other than the por-
tion covered by this easement, or to any buildings or structures on said
tract of land, other than the portion covered by this easement, arising
out of the use by Grantee of said easement, and the Grantee further
covenants that it shall in the construction, maintenance and repair of
said storm sewer, replace the surface of the ground, including sod, shrubs
and trees to as nearly as possible the same condition as existed prior to
such construction, maintenance or repair.
