Dahlgren - Title Regbtration District Court Case No. 14184 Dear Mrs. Albn; TELEPHONE FEDERAL 2 -3351 OF COUNSEL LEAVITT R. BARKER We enclose herewith a copy of the land title summons in the above - entitled matter that was served on the Village of Edina. We have checked the District Court File and find that the Village was named as a defendant in this proceeding because of a discrep- ancy in a description contained in a notice of lis pendens. The Village commenced a condemnation proceeding on part of Lot 7, Block 2, Peacedale Acres and, subsequent to the commence- ment of the proceeding, obtained a deed from the fee owners of the property. The Village's rights, of course, are governed by the de- scription contained in the deed. Therefore, we recommend that no action be taken with re- spect to this land title summons.
