the lays of the State of Minnesota, is the owner of the premises hereinafter
described, situated in the Village of Edina, County of Hennepin and State of
Minn= •sota, and
PYUS, said premises are within what is known as "Joint Seeger District
No. 1, Edina,11 heretofore created in said Village and with others, the under-
signed is desirous of having said joint sewer constructed and thereafter main-
twined for the service of its property.

Dollar (,1.00) in hand maid, the receipt whereof is hereby acknowledged, the
undersigned hereby gives and grants unto the Village of Edina, a municipal
coruoration of the County of Hennepin and State of Minnesota, a perpetual
easement ten feet (10 ft) in width and of the necessary depth for the con-
struction, installation, operation, maintenance and repair of a sewer in,
under, over and upon the following described premises, to grit:
A strip of land 10 feet wide across Lot D in White Investment
Company's ridden Valley addition, said strip being 5 feet on
each side of a straight line drawn from a point on the North
line of said Lot D distant 35 feet East of the Southwest cor-
ner of Lot J in Block 2 of %rhite Investment Company's Hidden
Valley addition to the point of intersection of the center
line of Beard Avenue South with the center line of West 55th
Street;
Provided that the Village of Edina by the acceptance of t'_nis easement hereby
agrees to adequately waterproof said sewer and bac1d ill so as to prevent said
serer or the ditch in which it is laid from acting as a drain for the waters
of Minnehaha Creek or the surface or sub - surface waters draining into said
creek, and that it will not unreasonably divert the original course of said
creek in the installation of said sewer. Any ezeavat-_on- -made by the Village
shall not be refilled until the undersigned shall be notified in writing and
shall have had five days within which to inspect said excavation.
It is understood that the said sewer will be constructed and thereafter
maintained as nearly as may be in the location upon said premises established
or to be established by the engineer in cl =arge of the construction of said serer.

executed in its corporate name by its President and its Secretary, and its
corporate seal to be hereunto affixed, this second day of August, 1939.

R.H.14hite, to me personally known, who, being each by me duly sworn, did.
say, that they are each respectively the President and the Secretary of
Yederal Investment Comvany, the corporation named in the foregoing instru-
ment, and that the seal affixed to said. instrument is the corporate seal
of said corporation, and the said instrument was signed and sealed in be-
half of said corporation by authority of its Board of Directors, and said
H. W.1Vhite and R.H.Uhite acknowledged said instrument to be the free act and
deed of said corporation.
