THIS INSTRUMENT, Made this 14th day of March �, 1957 , by
and between ALFRED A. GROSS AND IRENE M. GROSS, HUSBAND AND VIIFE,
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain., Sell, Convey and Warrant to said party of the second part an Easement
in perpetuity for sanitary sewer purposes,. including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit.
A Twenty (20) foot.strip of land lying within the following described prcpertyt
Commencing at the Northwest (NW) corner of the Southeast Quarter (SEI},
Section Thirty -one (31).. Township One Hundred Seventeen (117), Range - Twenty -one
(21); thence East Four Hundred Seventy -one and Five Tenths (471.5) feet;
thence South (S) parallel with the West (W) line of the Southeast Quarter (Sk)
a distance of One Thousand Six Hundred Sixty -eight (1668) feet to the centerline
of Eden Prairie Road; thence Southwesterly (Sally) along theAeenterline of said
road to a point on the West line of the Southeast Quarter (Sa) distance Two Thous-
and Fifteen and Three Tenths (2015.3) feet South of the Northwest (NW) corner
thereof; thence North. (N) Two Thousand Fifteen and Three Tenths (2015.3) feet
to beginning, except road. CThe centerline of said Twenty (20) foot strip of
land begins at a point on the East line of Walnut Ridge First Addition, said
point being Thirty (30) feet North of the Northeast corner of Lot One (1),
Block Two (2), Walnut Ridge First Addition; thence Easterly at.right angles
to said East line a distance of One Hundred Forty -nine and Fifty -seven
Hundredths (149.57) feet; thence Southerly at a deflection angle of Ninety
Degrees (900) right, a distance of One Hundred Twenty -five (125) feet; thence
Easterly at a deflection angle of Ninety Degrees (900) left, a distance of
Five Hundred Seventy -six and Seventy -five Hundredths (576.70 feet; thence
Southerly at a deflection angle of Ninety -two Degrees and Eleven Minutes (920111)
right, a distance of Four Hundred Forty -two and Ninety Hundredths (442.90) feet
to the North right -of -way line of State Highway #169 -212.
Together with a construction easement for entry onto the land of Twenty -five
(25) feet on each side of a centerline, which construction easement shall
cease and terminate upon the completion of the sewer contract.

It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
IN WITNESS: WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year first above written.
