Based upon such examination, we are of the opinion that the fee title to said premises is vested in Oreste M. Spande and Alouise J. Spande, husband and wife, as joint tenants, free and clear of all liens, charges and encumbrances, except as follows: 1, The original description conveying this property has for its Westerly boundary the following: "thence North along the West line, 210 feet to the point of beginning" The point of beginning is actually 250 feet.North along the rest line. However, the law is that points of reference govern over stated distances -1- DORSEY, COLMAN, BARKER, SCOTT & BARBER Village of Edina -2- March 16, 1955 if therelis a discrepancy and so this defeat could be passed. 2. The conveyance to the Spandes omitted any reference to the easement of access to this property. Although it may pass to them with the conveyance as an appurtenant easement, it would be a much safer practice to have it on record. Furtherp the easement by its terms is limited to ingress and egress and we do not feel that this would include imposing any further burden such as installing a water main. 3. Taxes for 1953 and 1954 are not reported. This opinion is limited to the matters shown by said abstract of title and the records referred to therein. All matters not so shown are excepted from this opinion and include (a) rights of any parties in possession, (b) possibility of liens for improvements in process or completed on the premises within the last ninety (90) days, (a) general zoning and building laws and restrictions., (d) special assessments., and (e) matters which an accurate survey of the premises would disclose.
