EASEMENT FOR 3ANITARY SEWER.
THIS INSTRUMENT, Made this2�V �'ay
and between Lester C. Anderson and Lee R. Ander
and wife
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grantp
Bargain, Sell, Convey and Warrant to said party of the second part an Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wits
A strip of land 15 feet wide adjacent to and on each side of the following
described line, said line being the centerline of Leslee Drive as platted.
Beginning at a point on the North right -of -way line of Jeffrey Lane a distance
of 323 feet East of the centerline of Blake Road, the centerline of Blake Road
being the West line of Section 32, Township 117 Alorth, Range 21 Nest of the
5th P.I.I. and the Tlorth right -of -way line of Jeffrey Lane being the South line
of the Horth 45 acres of the plorthwest Quarter of said Section 32; thence North
along the centerline of said Leslee Drive a distance of 95 feet to the point of
curve to the right; thence along said curve a distance of 86•.24 feet, the radius
of said curve being 55.56 feet, and a Delta angle of 080 561; thence Easterly
along said centerline a distance of 245.46 feet to the point of curve to the
left; thence along said curve a distance of 105.68 feet, the radius of said
curve being 365.94 feet, and a Delta angle of 230 35' 54 "; thence Northwesterly
on a straight line a distance of 121.07 feet to the center of the turn around,
the radius being 60 feet, said point in the center of the turn around being a
distance of 349.61 feet East of the West line of said Section 32 and a distance
of 176.54 feet North of the said South line of the PTorth 45 acres.
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation•
