R E S O L U T I O N
WHEREAS., The Village of Edina, Hennepin County, Minnesota, is
the owner of certain parcels of land, which land is described as follows : -
and
Lots 5, 6 and 7, Block 11 "EDErMOR, SIN COUNTY,
MINNESOTA," according to the map or plat thereof on
file and of record in the office of the Register of
Deeds in and for Hennepin County, Minnesota;
WHEREAS, the Village of Edina is desirous of subdividing the
aforesaid lots; and
WHEREAS, the division of the lots is to be made according to
the northerly line of Downing Street, which is described in that certain
instrument on file and of record as Document No. 316+311 in the office of
the Register of Deeds in and for Hennepin County, Minnesota, as:
and
"A 50-foot right -of-way, the centerline of which is
described as follows: 'Commencing at a point on the
Easterly line of Sherwood Road, said point being 25
feet South of the Southwest corner of Lot 3, Block 1,
Edenmoor Addition; thence Easterly parallel to and 25
feet Southerly of the South line of said Lot 3 a dis-
tance of 80 feet to a point of curve to the right,
having a radius of 70 feet and a central angle of 90
degrees; thence along the arc of said curve to the
right a distance of 109.96 feet to the end of said
curve; thence South and tangent to the last described
curve a distance of 12.51 feet to a point of curve to
the left having a radius of 70 feet and a central angle
of 90 degrees; thence along the arc of said curve a
distance of 109.96 feet to the end of said curve; thence
Easterly to a point on the Easterly line of Edenmoor
Addition, said point being 177.51 feet South of the
Southeast corner of Lot 1, Block 1, Edenmoor Addition,
said point being the termination point of the roadway";
WUMMAS, the Village of Edina is desirous of conveying that part
of each of said Lots lying North and East of said Northerly line of

Downing Street, and of retaining title to that part of each of said Lots
lying South and West of the aforesaid line; and
WHEREAS, it has been determined that the requested division does
not interfere with the purposes of the provisions relating to subdividing
in Ordinance No. 261;
NOW, THEREFORE, it is hereby resolved by the Village Council of
the Village of Edina that the division requested is, and the conveyances
to be made of the above described portions of said.lots are, hereby
approved and the requirements and provisions of ordinance No. 261 are
hereby waived as to said division and conveyances. Subject, however, to
the provision that no further subdivision shall, be made of any of said lots
as hereby approved unless made in compliance with the pertinent ordinances
of the Village of Edina or with the prior approval of this council as may
be provided for by these ordinances.

RESO'LUTION
WHEREAS, the Village of Edina is the owner of the following
described property situated in Hennepin County, State of Minnesota,
to-wit:
and)
WHEMS, it is deemed necessary and advisable and to be in
the public interest that said property be hereafter used and dedicated
as a public street,
NOW, TBEREFORE, BE IT RESOLVED by the Village Council of the
Village of Edina that said property as heretofore described be and is
hereby dedicated for public street purposes.

Motion for adoption of the Resolution was seconded by Tupa, and on Rollcall
there were five ayes and no nays, as follows: Bank,.ayes Dickson, ayes
Kohler' ayes Tupav ayes and Bradesen, ayes and the Resolution was adopted.

I, the undersigned, duly appointed and acting Village Clerk for the
Village of Edina, Hennepin County, Minnesota, do hereby certify that I have
examined the attached and foregoing "Resolution Dedicating Downing Street%
and that the same is a fail, Me and- correct copy of a- resolution adopted
by the Edina Village Council at its Regular Meeting held 16onday, December 22,
1958. I further certify that all members of said Council were present at
said meeting, and voted favorably upon the resolution.
