Gentlemen: We have examined the title to the above - described premises as shown by an abstract of title last certified to May 14, 1959, at seven o'clock A.M. by Title Insurance Company of Minnesota. Based upon such examination, we are of the opinion that as of May 14, 1959, the fee title to said premises was vested in SUBURBAN DEVELOPERS, INC., a Minnesota corporation, as to an undivided 59 %100ths of said property, and INDIAN HILLS CORPORATION, a Minnesota corporation, as to an undivided 41/100ths of said property, free and clear of all liens, charges and en- aunbrances except as follows: 1. A mortgage dated December 18, 1954, filed December 20, 1954, and recorded in Book 2824 of Mortgages, page 55. This mortgage runs from Indian Hills Corporation to Suburban Developers, Inc., and we will require that it be satisfied. 2. The easterly and northerly 33 feet of the above - described property is shown on the half section sheet at the Register of Deeds as Olinger Road. The abstract of title does not disclose that this property has ever been formally dedicated for road purposes. We as- sume, however, that the road is in and that it is used for public road purposes. 3. Taxes for 1957 and prior years are paid in full; taxes for 1958, due and payable in 1959, on the above - described and other prop- erty remain unpaid in the amount of $4,750.07. W I ' v. Each lot shall have a frontage on a public street of not less than 75 feet. 2. The average minimum depth of all the lots in the proposed plat or subdivision shall be not less than 120 feet. 3.
