FE 9-4546 '71.3 `7 13 i f 325E S:10 EASEMENT FOR STREET PURPOSES THIS INSTRUMENT, Made this _L�_ day of August, 1960, by and between EDINA HOLDING COMPANY, a corporation under the laws of the State of Minnesota, party of the first part, and the VILLAGE OF EDINA, a municipal corporation organized under the laws of the State of Minnesota, party of the second part; WITNESSETH, That the said party of the first part, in consideration of One and no /100 Dollars ($1,00), and other good and valuable consideration, does hereby Grant, Bargain, Sell and Convey to said party of the second part, an Easement in perpetuity for street purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing a street in, over, and upon the following described property situate in the County of Hennepin and State of Minnesota, to -wit: A strip of land six (6) feet in width lying between the present highway easement and a line running parallel with and twenty -six (26) feet west of the east line of the Southwest Quarter of Section 18, Township 28, Range 24, between the South line of said Southwest Quarter and the center line of Minnehaha Creek, This easement is given without substantial consideration being paid to the party of the first part, on condition, however, that should the Village of Edina, the State of Minnesota or other governmental authority hereafter acquire or condemn land extending west of the strip of land hereinabove described, first party has not, by the giving of this grant of easement, waived its right to claim compensation, damages and payment for the six (6) feet herein eased, together with any additional property so acquired or condemned. Raymond Nelson, to me personally known, who, being each by me duly sworn, did say that they are respectively the President and the Secretary of the EDINA HOLDING COMPANY, the corporation named in the foregoing instrument and that the seal affixed to said instrument is the corporate seal of said corporation, and that said instrument was signed and sealed in behalf of said corporation by authority of its Board of Directors and said Philip Neville and J.
