THIS I1�TRUMEET, Made this ! day of �, 1961,
by and between THE STOW COMPANY, a corporation under the ws of the State of
Minnesota, party of the first part, and the Village of Edina, a municipal cor-
poration organized under the laws of the State of Minnesota, party of the second
per;
WITNESBETH, That the said party of the first part, in consideration
of One and no /100 (1.00) Dollars, to it in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, does Grant, Bargain,
Sell, Convey, and Warrant to said party of the second part an Easement in
perpetuity for storm sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing, and reconstructing
a storm sewer system in, under, and over the following described property
situate in the County of Hennepin and State of Minnesota, to -wit
Those parts of the Northeast Quarter of the Southeast Quarter
of Section 5, Township 116, Range 21, according to the United
States Government survey thereof, Hennepin County, Minnesota,
described as follows, to -wit:
A 20 foot hide strip of land, being ten feet on each side of
the following described center line, to -wit: Beginning at a
point on the West line of said Northeast Quarter of the South-
east Quarter, distant 180 feet South of the Northwest corner
thereof; thence East parallel with the North line of said
Northeast Quarter of the Southeast Quarter, a distance of
t 82.51 feet; thence North 120 671 26" East for a distance of
163.58 feet, and there terminating;.for the purpose of this
description the North line of said Northeast Quarter of the
Southeast Quarter is assumed to be a due East and West line;
Also,
The North 30 feet of that part of said Northeast Quarter of
the Southeast (4uarter lying Easterly of the West 95 feet of
said Northeast Quarter of the Southeast Quarter, and Westerly
of the Center line of Nine Mile Creek;
Also,
The South 60 feet of that part of said Northeast Quarter of the
Southeast Quarter, lying Westerly of the Center line of Nine
Mile Creek.
It is the intention and agreement of the parties hereto.that -.the

party of the second part shall in the construction, or maintenance of said
storm sewer replace any shrubs or sod removed by any excavation in connection

with such construction or maintenance work, in as nearly as possible the same
condition as before such excavation.
