Of Hennepin and State of Minnesota, parties of the first part and the
VILLAGE OF EDINA, a municipal corporation organized under the laws of the
State of Minnesota, party of the second part,
WITNESSETH:
That the parties of the first part in consideration of the sum
of One and No/100 ($1.00) Dollars and other good and valuable consideration
to them in hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant
to said party of the second part an Easement in perpetuity for the flowage, 1 /
storage and drainage of surface waters, natural or otherwise,

in the office of the Registrar of Titles in and for
Hennepin County, Minnesota;
Parties of the first part hereby warrant and affirm to party of
the second part that all the remainder of Lot 7
Block 4, LAKE EDINA
,Z24 ADDITION, not hereinabove conveyed to said party of the second part,
is of an elevation which is equal to or higher than Eight Hundred Twenty-five
(825) feet, 1929 sea level datum, and parties of the first part hereby agree
to save, indemnify and hold harmless the Village of Edina from any and all
liability, damage or inconcenience which may in anywise occur, arise or
result from the storage, flowage, seepage and drainage of surface water,
natural or otherwise, over any part of said lot below an elevation of
Eight Hundred Twenty-five (825) feet, 1929 sea level datum.
IN TESTIMONY WHEREOF, the said parties of the first part have
hereunto set their hands and seals the day and year first above written.
