EASEMENT FOR STORM SEWER PIPELINE AND OFEN
DRAINAGE DITCH
THIS INSTRUMENT, Made this 28th day of Dwember , 19-&'
by and between ELI A. SULANDF,R., a single man and ROBERT L. TAYLOR and
us and and wife,
of the County of Hennepin and State of Minnesota,
part ies of the first part, and the Village of Edina, a municipal corporation
organized under the laws of the State of Minnesota, party of the second
part;
WITNESSETH, That the said part ies of the first part, in consideration
of One and No /100 Dollars ($1.00), to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do
Grant, Bargain, Sell, Convey and Warrant to said party of the second part
an Easement in perpetuity for storm sewer purposes, including the right
to enter for the purpose of constructing, maintaining, altering, repairing
and reconstructing a storm sewer system, whether by storm sewer pipeline or
open drainage ditch in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
The Easterly 10 feet of the following described property:
The South 72.6 feet of the North 662 feet of the West
300 feet of the Northeast Quarter of the Southwest
Quarter of Section 32, Township 117, Range 21, according
to the United States Government Survey thereof, Hennepin
County, Minnesota.

It is the intention and agreement of the Parties hereto that the
party of the second part shall in the construction, or maintenance of any
storm sewer pipeline replace any shru'ps or sod removed by an excavation in
connection with such construction or maintenance work, in as nearly as possible
the same condition as before such excavation. Nothing herein shall prevent
party of the second part from constructing a storm sewer system consisting of
pipeline subsequent to its original construction of a storm sewer system
consisting of an open drainage ditch, or vice versa.
