EASEMENT FOR STORM SEVER
THIS INSTRUMENT, Made this 7 day of NnvPmher , 19,61,, by
and between
Rughand nQd Wife P , of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
All that part of Lot 36, warden Acres, Hennepin County,
.Minnesota; according to the plat thereof on file and of record in the
office of the Registrar of Deeds in and for Hennepin County, Minnesota,
together with any part or portion of any street or alley lying adjacent
thereto, heretofore vacated; which extends five feet (5') on each side
of the following described centerline:
Beginning at a point on the north line of said lot located one - hundred
and twenty -five feet (125') east of the northwest corner of said Lot 36;
thence south to a point on the south line of said. Lot 36 located one -
hundred and twenty -five feet (125') east of the southwest corner thereof
and there terminating.
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.
