EASEMENT FOR DRAINAGE DITCH
THIS INSTRUMENT, Made this 7th day of November j
1960, by and between Gust A. Johnson and Son -, a corporation
under the laws of the state of Minnesota, party of the first part, and
the Village of Edina, a municipal corporation organized under the laws
of the State of Mirnesota, party of, the second part;
WITNESSETH., That the said party of the first part, in consideratio:
of one and no/100 (1.00) Dollars, to it in hand paid by the said party of
thO',--second part, the receipt whereof is hereby acknowledged, does Grant,
Zar6ain, Sell, Convey, and Warrant to said party of the second part an
in peri,)etuity for storm sewer purposes, including the right to
enter for the purpose of constructing, maintaining, altering, repairing,
and re=nstructing a storm sewer system in, under, and over the follow-
ing described propnrty situate in the County of Hennepin and State of
Minnesota, to-wit: A drainage ditch easement in and over a tract of land
lying in the NEE of the NW;A of Sec. 51 T-116-N, R-21-W and SEk of the MA
of Sec. 5, T-116-M, R-21-W, said tract to be 100 feet in width for con-
struction purposes and 30 feet in width for open drainage lines; the
centerline is snore particularly described as follows: Co,.Muencing at the
north 1/4 corner of Said Sec. 5; thence bearing South 375 feet; thence
bearing South 480 iqest, distance 370 feet; thence bearing vlest 320 feet;
thence bearing South 530 West, distance 57 feet, more or less, to the
,intersection with a line lying 663 feet South of and parallel to the North
line of the V24 of NWk of said section, which intersection point is the
Point of Beginning of the drainage easement centerline to be described;
thence continuing at the same bearing of South 530 West, distance 544
feet; thence bearing south 40 West, distance 462 feet; thence bearing South
45® West, distance 280 feet, more or less, to a point distant 15.0 feet
easterly, in a perpendicular direction, from the West Line of said quarter-
quarter; thence southerly along a line parallel to said West Line and 15.0
feet distant easterly, in a perependicular direction, to the intersection
with the North Line of the South 35 acres of the SE4 of the NWh of said
section.
For the purpose of the foregoing description, the bearing of the East Line
of the NEh of the NWh of said section has been assumed to be due North-
South
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance of
said ditch replace any shrubs or sod removed by any excavation in
connection with such construction or maintenance work, in as nearly as
possible the same condition as before such excavation.
TESTIMONY WHEREOF, The said first party has caused these
