THIS INSTIL, Made this day of , , by
and between THORSTSIN F. GOGWARS011 and RITA J. GC)0A"SON, husband and
wife and OSCAR NAUSTDAL and DOW MA$ KAUSTDAL, husband and wife, of the
County of Hennepin and State of Minnesota, parties of the first part,
and the Village of Edina, a municipal corporation organized under the
laws of the State of Xinnesota, party of the second part;

tion of One and 1501100 Wllars ($1.o0), to them in hand paid by the said
party of the second part, the receipt whereof is hereby acknowledged,
do Grant,. Bargain, Sell, Convey and Warrant to Said party of I 'the second
part an Easement in perpetuity tar all utility and drainage purposes
Including, but not being limited to, sanitary seater, storm sewer, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage`eyetems in and over the following described property situate
in the County Of Hennepin and State of Minnesota, to -wit:
The best Twelve (12) feet of the South Two Hundred Seventy
(270) feet of the west 1/2 of the South 1/2 of Block 22,
Mendelssoba, except the South 235 feet of the East 90 feet
thereon.
Together with a temporary construction easement five (5)
Peet in width alomg, adjacent to and East of the Twelve (12)
foot easement area above described, which temporary
construction easement shall cease and taminate on July 15,
l9&.
Because said easement herein conveyed exists over property
owned by both Thorste n F. Goodmansoo and Rita J. (loodmanson and by Oscar
Nauastdal and Aouna Mae Na►ustdal, all of first parties Join herein; the portion
of the above described property owned by each of first parties being as
follows:
1. T'horstein F. Goodmanson and Rita Zt. Goodmanson, husband
and wife, own the West 1/2 of the South 1/2 of Block 22,
Naeadelasohn, except the South 235 feet thereof'

2. Oscar Naustdsl and Donna Mae Naustdal,husband and wife,
own that part of the South 235 feet of the West 1%2 of
the South 1/2 of Block 22, Mendelsuohn, lying West of
the Vast 90 feet thereof.
It is the intention and agreement of the parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage systems replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
