DECLARATION
WHEREAS, ROBERT W. CARLSON and MARY E. CARLSON,

"Declarants his•wife, sometimes hereinafter called the -Declarants are the owners

of certain property situate in the Village of Edina, County of Hennepin,
i
i State of Minnesota, legally described as follows:
Lots 5 and 6, Block 1, Carlson's Park, according to the
j recorded plat thereof,

WHEREAS, the- Village of Edina has construed a sanitary lateral
i
sewer on Rolling Green Parkway which is available to service said Lot 6,
and
WHEREAS, the Declarants intend that no more than one single family
residence and buildings incidental thereto including a private garage will be
permitted at any one time on said Lots 5 and 6 and sanitary sewer service
is available to Lot 5 from Interlachen Boulevard, the cost of which has hereto-
fore been assessed against said Lot 5, and
WHEREAS, the Village of Edina has indicated its willingness not to i
assess the cost of said sanitary lateral sewer service against said Lot 6
subject to the terms hereinafter provided.

NOW, THEREFORE, in consideration of the Village of Edina not
assessing said Lot 6 of the above described property and in further con -I
sideration of other good and valuable consideration, the receipt and sufficiency
of which are hereby acknowledged by said Declarants, said Declarants do
hereby impose upon said above - described property the following covenants and
restrictions:
1. No more 'than one single family residence and buildings incidental
thereto including a private garage shall be permitted at any one time on the
above- described property.

Declarants for a period of thirty (30) years from the date hereof.
3. The covenants and restrictions herein contained shall be for
the benefit of the. Village of Edina, and the Village of Edina shall have the
right to enforce the same in law or in equity including but not limited to the
right to enjoin any violation thereof.
4. If Declarants wish at any time after December 31, 1975 to

subdivide said property in accordance with Village platting requirements {
or to be relieved of the provisions hereof, the Village of Edina may release
- these covenants and restrictions upon the payment of $ 1, 707. 11 plus
interest at 5% per annum from September. "7, 1965 to December 31, 1975.
IN TESTIMONY WHEREOF, Declarants have hereunto set their
