EASEMENT
THIS INSTRUMENT, Made this 6th day of December ,19 _0, by

a corporation under the laws of the State of 1111 party of the first
part, and the Village of Edina, a municipal corporation organized under.
the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party cif the fi -rst part, in consider",
ation of One and No/100 Dollars ($1.00), to them in hand paid by the said
party of the second part, the receipt whereof is hereby acknowledged, do
Grant, Bargain, Sell, Convey and to said party of the second part
an Easement in perpetuity for all utility and drainage purposes including,
but not being limited to, sanitary sewer, storm sewer, water pipes, in-
cluding the right to enter for the purpose of constructing, maintaining,
altering, repairing and reconstructing said utility and drainage systems
in and over the following described property situate in the County of
Hennepin and State of Minnesota, to -wit:
That part of Tract F lying South of a line drawn parallel to
the South line of said Tract F and distant 220 feet North of the South line
of Tract F, as measured at right angles to said South line, in Registered band
Survey No. 629, Files of the Registrar of Titles, Hennepin County, Minnesota,
which is described as folloarst A Twenty (20) foal wide strip of land lying
Easterly of and abutting the Easterly line of York Avenue, (being Tract D,
said Registered Fend Survey) and running fraan the South line of said Tract F
to the North line of that part of Tract F herein d eseribed.
This instrusent is esmpt frca state deed tax.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
wA auy blacktop and
of said utility and drainage systems replace any shrubs or sod/removed c
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
IN TESTIMONY WHEREOF, The said first party has caused these presents
to be executed in its corporate name by its President and its
Secretary- Treasurer and its corporate seal to be hereunto affixed the
day and year first above written.

Public, within and for said County, personally appeared. Hobert Shu €tldt
and L. H. Kuh 1 , to me personally known, who, being each by me
duly sworn, did say that they are respectively the President and the
Secretary- Treasurer of the corporation named in the foregoing instrument
and that the seal affixed to said instrument is the corporate seal of said cor-
poration, and that said instrument was signed and sealed in behalf of said cor-
poration by authority of its Board of Dire*tWs and said Robert Shufeldt
and L. H. Kuhl acknowledged said instrument to be the free act
and deed of said corporation.
