of the County of Reanepin
and State of Minnesota, parties of the first part, and the Village of
Selina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNSSSSTN, That the said parties of the first part, in consid-
*ration of One and No/100 Dollars (41.00), to then in hand paid by the'
said party of the second part, the receipt whereof is hereby acknowledged,
do Brant, Bargain, Sell, Convey and Warrant to said party of the second
part an Rosemont in perpetuity for all utility and drainage purposes
Including. but not being limited to, sanitary sewer, store saver, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
In the County of Rsnnspin and State of Minnesota, to -grits
That part of Lot 3, Block 1, Lampe's Subdivision of Lots 8 thru 23, Willard's Subdivision of
Block 17, Msndelssohn, according to the plat thereof on file or of record in the office of the
Registrar of Titles in and for Nennepin County, Minnesota, which lies within 10 feet on either
side of the following described center line:
Commencing at a point 5 feet North of, measured at right angles to, the South line
of Lot 15, Griffis' Sub, of Block 180 according to the recorded plat thereof, and
150 feet West of the center line of Arthur Street, when measured along a line 5 feet
Borth of and parallel with the South line of said Lot 13 and its extensions; thence
Morthwesterly to the intersection with a line drawn 13 feet North of and parallel with
the South line of Lot 19, and its extensions, said Griffis' Sub. of Block 18, at a
point thereon 183 fast West of the center line of Arthur Street, when measured along
said parallel line.
Also a temporary construction easement which shall cease and terminate on November 30, 19659 ever
and along two 5 foot strips of land, one lying Northeasterly and one lying Southwesterly of, and
both adjacent to, the permanent easement above described.
Also that part of Lot 30 Block 19 said Lamps's Subdivision of Lots 8 thru 23, Willard's
Subdivision of Block 17, Mandelssohn, which lies Sasterly of a line drawn 5 feet Westerly of
and parallel with the following described line:
Commencing at a point on the South line of Lot 13, said Griffis' Sub. of block
18, 163 foot Westerly, when measured along the South line of said Lot 15 and its
Sasterly extension, from the canter line of Arthur Street; then** North, at a
right angle to the South line of said Lot 15, a distance of 107 feet, and there
terminating.
It is the intention and agromsent of the parties karate that the
party of the second part shall in the construction, or maintenance of said
utility and drainage systems replace, with at least the equivalent size and
value, any shrubs, trees or sod removed or killed by any excavation in can-
section with such construction or maintenance work, in ss nearly as possible
the same condition as before such excavation.
This instrument is exempt from state deed tax.
