AND WHEREAS, party of the second part desires an easement over
said property for the purpose of storage of water;

maintenance and repair of a reservoir to contein water on that part of 'said

the first part shall hava and hereby reserve the right to fill, improve and
build on that part of said first described property lying between said
Lines A and B.

to parties of the first part, their property and any and all other persons and
property, not occasioned by or proximately resulting from negligent acts of
said party of the second part or its agents or empployees, which may occur
as a result of either party exercising rights granted under this agreement.
This instrument is exsapt from State Deed Tax.
