SEWER EASEMENT
This agreement made this y of January, 1937, between the
Village of Morningside, Hennepin County, Minnesota, hereinafter called
"Village" end William D. Vohs and Katherine F. Vohs, husband and wife,
hereinafter called "Owners ".
The owners hereby grant to the Village the right to lay and forever
maintain and use its sewer man across the northerly portion of lot 11,
A4ditor's Sub — Division No. and as close to the northerly line of said
lot as feasible;'also the fig ht to construct and maintain connections in
said sewer main for the purpose of serving Morningside residents as well .
as the owners the right in the future to enter upon said land for the
purpose of making any repairs to said sewer which might become necessary,
it being understood tnat in such event the Village will replace the
earth and put it in substantially the same condition as at the time of
making any such repairs.
In consideration of the foregoing right the Village hereby grants
to the owners, their heirs, representatives and assigns the right to
connect with said sewer and to use the same without the payment of any
cost to the Village for the construction of said sewer main.
This easement shall run with the land and shall be binding upon the
owners, their heirs, representatives, and assigns forever.
IN WITNESS WHEREOF the parties have duly executed this agreement
the day and year first above written.
