PAUL �LT_UR°^dd RR4LILRO`1D C012 -lY, a Minnesota corpor=ation, party of the second part, :iIT�:y'SSET: ,qIE y AS the first party desires to drain surface water from the street intersection of France avenue South and 44th Street; and 3 the most convenient and natural drainage for said surface water is in a westerly direction along; the right -of -way of second party to a low spot on property owned or controlled by first party; TH=E -EFORE, in consideration of the promises herein contained to be kept and performed by first party, second party hereby consents and agrees that first party may at its own risk and expense install and maintain a drainage pipe from the westerly sidd of France Avenue at 44th Street, along and upon the southerly side of the right -of -way of second party, in a wester- ly direction, a distance of Three hundred fifty -six and 4/10 (356.4) feet, said drainage pipe to be on a uniform grade to drain surface water only from France Avenue and shall be placed parallel to and five (5) feet northerly from the southerly right -of -way line of second party.
