THIS INDENTURE, Made this day of August, in the
year of our Lord one thousand nine hundred and twenty-six (1926)
between INDEPENDENT SCHOOL DISTRICT NO 17, of the County of
Hennepin and State of Minnesota, party of the first part, and
VILLAGE OF MORNINGSIDE9 a Municipal Corporation, of the County of
Hennepin and State of Minnesota, party*of the second part,;
WITNESSETH, That for value reoeivedt which is hereby
acknowledged, said party of the first part does hereby grant
bargain, sell and convey unto the said party of the second part
and its successors, for the use and benefit of the publio, an
easement for I street purposes over and upon the following described
piece or parcel of land situated in the County of Hennepin and
State of Minnesotat known and described as follows;
Beginning at the Southwest 'corner of the Southeast,
Quarter of the Northeast Quarter of Section Seven (1).
Township Twenty- eight, (28) North, Range Twenty-four
(24) West; thence North,Six�Hundred Sixty (660) feet,
more or less, to the Northwest corner of the South Half
of the Southeast Quarter of the Northeast Quarter of the
said Section; thence East Twenty five (85) feet; thence,.,
South parallel to the'West line of the Southeast Quarter..
of the North"st Quarter of said Section Seven (7) a
distance of Six Hundred Thirty-five (635) feet, more 'or
less, to: a point which is Twenty-five (25) .feet North of
the Quarter line of Section Seven (7); thence-East and
parallel to the quarter line of said Section Seven (7)

(414,63) feet East-of the West line of the Southeast,.,,

thence East Twenty-five (25) feet; th4noe South Six"Madied
Sixty (660) feet more or less.,to a point in the Quarter
line of Section Seven (7) which 'is Your Hundred Thirty -nine
and 75/100 (439.75) feet East of the Southwest corner of_
the Southeast Quarter of the Northeast Quarter ofsaid
Section Seven (7); thence West along the quarter line of
said Section Seven (7) to the point of beginning:
TO HAVE AND TO HOLD the said easement together with all the
hereditaments and appurtenances thereunto belonging or in anywise
appertaining, unto the said party of the second part and itit

said easement shall be used for public street. It is an express

condition of this conveyance and dedioation that in case of the �
vacation of said street, or any part thereof, by any competent
authority, or the failure of the party of the second part or the
public to keep and use the same for public purposes, .the reversion
and title in fee thereto is hereby expressly reserved and. declared
to be in the party of the first part, its successors air, assigna.

Chairman and Clerk and its corporate seal to be hereunto affixed
