the Village of Lorningside represents to your honorable body that certain
parties residing in the Village of ITorningside have heretofore at times
used a certain cartway or pathvra}* over and across said lots running in a
general northwesterly and southeasterly direction, and it is claimed that
the said use of said cartway or path has created a public easement for
street or roadway purposes thereon,
And the undersigned hereby petitions your Honorable Body that said
street, highway, road or public easement, if any there be, over and across
said lots be vacated by resolution of your Honorable Body in the manner
specified by law.
It is further represented and shown to your Honorable Bodv that
the undersigned has dedicated an easement of right -of -:ray for road purposes
over and across the southerly seven feet of said lots to the Village of
IJorningside, together with an adjacent five (5) foot strip lying within the
Village of 'Edina and dedicated to said Village of Edina so that the only
persons who formerly had any claim of right to use the cartway or pathway
hereby sought to be vacated no longer have any right or necessity for using
such cartway or path, aril it is to the best interests of the public that
this petition be granted and said cartway or path vacated.
