of Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part, WITNESSETH:
WHEREAS, parties of, the first part own title to the following
dQscritoed property situate in the County of Hennepin and State of
Minnesota, to-wit.
Lot 4, Block 40 Mendelssohn Addition$ according to the map or
plat thereof on file or of record in the office of the Registrar
of Titles, Hennepin County, Minnesota.
AND WHEREAS, party of the sec ad part desires an easertient over

parties of the first part do hereby grant, bargain, sell, convey and warrant

the first part shall harEe and hereby reserve the right to fill, improve and

Lines A and 3 are de-scribed as follows, to-wit:

Line A Co=ining at a point on the North line of Lot 4,
Block 4, Mendelsohn Addition, said point being
nine feet (911) nest of the Northeast corner thereoft
thence Southerly to a point in said Lot 4, said
point being nineteen feet (190) West of the Bast
line and twenty -three foot (230) North of the South
line of said Lot 41 thence Southwesterly to a point
on the South line of said Lot 4, said point being
forty -six feet (461) West of the Southeast corner
of said Lot 4 and there terminating.
Line B Coarsening at a point on the North line of Lot 4,
Block 4, lMndelssohn Addition, said point bring
fifty-two feet (520) West of the Northeast corner
thereof= thence Southwesterly to a point in said
Lot 4, said point being sixty -six feet (660) West
of the Bast line and twenty -eight feet (280) North
of the South lint thence Southwesterly to a point
on the South line of said Lot 4, said point being
one hundred seventeen feet (1170) West of the South-
east corner of said Lot 4, and there terminating.
It is .further agreed that the party of the second part shall not
be liable for, and that parties of the first part shall hold said party of
the second part harmless against all damage, expense, cost, logs and liability
to parties of the first part, their property and any and all other persons and
property, not occasioned by or proximately resulting from negligent acts of
said party of the second part or its agents or employees, which may occur
as a result of either party exercising rights granted under this agreement.
Provided* however, that the part of the second part
shall in maintenance of said reservoir replace any trees,
shrubs or sod disturbed in connection with such maintenance
work in as nearly as possible the same condition.
This instrument is exempt from State Deed Tax.
IN WITNESS WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year first above written.
