EASEMENT FOR STORM SEWER

a corporation under the laws of the State of Minnesota, party of the first
part, and the Village of Edina, a municipal corporation organized under the
laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in consideration
of One and no/100 (1.00) Dollars, to it in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, does Grant, Bargain,
Sell, Convey, and Warrant to said party of the second part an Easement in per-
petuity for storm sewer purposes, including the right to enter for the purpose
of constructing, maintaining, altering, repairing, and reconstructing a storm
sewer system in, under, and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wits
The North ten feet (10') of the East three hundred fifty feet
(3501) and the North twenty -five feet (251) of the West nine
hundred forty and forty -seven hundredths feet (940.471) of the
following described property; commencing at the - Northeast
corner of the Northeast one - quarter (N.E.k) of Section 6,
Township 27, Range 24; thence South six hundred fifty -five feet
(6551); thence West eight hundred ninety -five and four tenths
feet (895.41); thence South to a point two hundred fifty feet
(2501) North from the South line of the Northeast one- quarter
(N.E.k) of the Northeast one - quarter (N.E.k) said Section 6;
thence West to the West line of said Northeast one - quarter
(N.E.k) of the Northeast one - quarter (N.E.k); thence North to
the Northwest corner of said Northeast one - quarter (N.E.k) of
the Northeast one - quarter (N.E.k); thence East to the point of
beginning, except road.
This instrument is exempt from State Deed Tax
It is the intention and agreement of the parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.
