THIS INDENTURE, Made this `. day of

banking association, and ARTHUR POSINGIES (also known as Arthur
G. W.. Posingies) and WALTER POSINGIES (also known as Walter M.
Posingies), as Executors of the Estate of Michael Posingies,
deceased, party of the first part, and VILLAGE OF EDINA, a
municipal corporation under. the laws. of the State of Minnesota,
party of the second part,. ,
WITNESSETH,,that whereas Michael Posingies, late of the
Village of Edina, in the .County of Hennepin and State of Minnesota,,
deceased, in his lifetime, made and executed his Last Will and
Testament, bearing dat`e'the 10th day of October,- `-,1962, whereby .
among other things, he constituted and appointed First National
Bank of Minneapolis, Arthur Posingies and Walter Posingies executors
of his said Last Will and Testament, and did thereby empower the
said executors to sell and dispose of the real estate belonging
to the said testator at the time of his death, which Will was duly
admitted to probate on the 28th day of October, 1966, by the
Probate Court of.Hennepin County, Minnesota.
NOW,. THEREFORE, The said party of the .first part, by
virtue of the power and authority to it given in and by the said
Last Will and Testament,. and inconsideration of the sum of TWO
DOLLARS, to it in hand paid by the said party of the .second part,
the receipt whereof is hereby acknowledged, does hereby. Grant,
Bargain, Sell, and Convey, unto the said party of the second part,;..i.

WHEREAS, two weeks` published notice and posted notice of a hearing to be
had on June 1, 1964, at 7:00 P.M., on the petition of John D. Newell, 6434
Warren Ave., and others, for the Vacation of that part of W. 65th Street
lying between the West line of Warren Avenue and the West line of "Norman -
dale Second Addition" has been given and made, and a hearing has been had
thereon by the Village Council:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Edina,
Hennepin County, Minnesota, that the following street is hereby Vacated:
THAT PART OF "W. 65TH STREET" LYING BETWEEN THE WEST
