The 5 -foot utility easement which we are seeking to eliminate was originally delineated on an underlying plat and it directly affects the petitioners' lot, which is known as 4708 Trillium Lane. The names of the respondents appearing in the title have an interest in other lots in the underlying plat. Upon receiving and filing the Report of the Examiner.of Titles in the above entitled matter, IT IS ORDERED, that you, and all persons interested, appear before this Court on the / -"' day of Ri , 1968, at 2:00 p.m., in Room 10 -A of the Hennepin.County Court Houle in said''County, and.then or as soon thereafter as said matter can be.heard, show cause, if any there be, why this Court should not enter an Order as follows: i 1. Thht the Registrar of Titles, upon the filing with him of a certified copy of this Order, show by memorial upon Certificate of Title No. 416219, that the premises therein described are free of the 5 -foot utility.and drainage ease- ments as shown on the plat of Lake Edina 2nd Addition and as reserved in instrument, Doc. No. 607213. 2. That upon the issuance of any future Certificates of.Title for the premises therein described, he omit the recital "subject to utility and drainage easement as shown on the plat of Lake Edina 2nd Addition" but that he carry forward the memorial of this Order. IT IS FURTHER ORDERED, That this Order be served at least 7 days prior to such hearing upon the above named parties residing in this State in the manner provided by law for the service of summons in a civil action; it shall be served at least 10 days prior to such hearing upon any of the above named non- residents by sending this Order by mail to such non- resident at his post - office address as stated in the Certificate or in any registered instrument on file with the Registrar, or if his address is not so stated, then to his last known address by registered or certi- fied mail, return receipt; it shall be served by 2 weeks published notice upon any party whose address is unknown.
