EASEMENT AND WAIVER OF DAMAGES
For and in consideration of the sum of One Dollar ($1.00) and
other valuable consideration, the receipt whereof is hereby acknowledged,
grantor does hereby grant, bargain, sell, release and quit claim to the
Village of Edina, a municipal corporation, in the County of Hennepin,
State of Minnesota, a perpetual flowage easement and right and privilege
to trespass with water over and above any or all of the lands of grantor
hereinafter described, as such flowage may be affected by the construction
of dams, dikes, ditches, diversion work and other structures, under all
conditions, ordinary and extraordinary, at all seasons of the year; and
the right and privilege to trespass on the land subject to this easement
with dams, dikes, ditches, diversion work, and other structures.
Grantor does hereby further grant, bargain, sell, convey and
otherwise forfeit any right to dump upon, fill, otherwise grade or raise
the level of the land subject to this easement.
This easement is given by the grantor hereof insofar as the
structures herein before described affect or may affect the lands owned
by said grantor situated in Hennepin County, State of Minnesota, more
specifically described as follows, to wit:
All that pLrt of the North 150 feet of the East 125 feet of the West
450.5 feet of the NE 1/4 of Section 30, Township 28, Range 24 lying South-
westerly of the following described line: Commencing at a point on the
East line of the above described property a distance of 35 feet North of
the Southeast corner; thence Northwesterly to a point on the West line of
above described property said point being 110 feet North of the Southwest
corner thereof and there terminating.
The grantor herein hereby certifies that the lands herein
described are free and clear of all encumbrances except.
It is further agreed that the grantor herein does hereby re-
miss, release, acquit and forever discharge on his behalf and on behalf
of his heirs, successors, representatives, grantees or assigns, forever

the Village of Edina, Hennepin County, Minnesota, and any and all of its
officers and employees of and from any and all claims, demands, or causes
of action of any kind or nature whatsoever, which may arise or accrue by
virtue of any flowage or trespass within terms of this easement.
All of the provisions hereof shall run with the land and
shall extend to and bind the heirs, successors, representatives, grantees
or assigns of the respective parties hereto.
