The zerox copy of the warranty deed should be forwarded to the city assessor for the purpose of exempting the property from real estate taxes payable in 1970 and all subsequent years. BARKER February 19, 1969 Re: The Southerly 189.5 feet of the East 60 feet of Lot 43, Auditor's Subdivision number 172, according to the map or plat thereof on file or of record in the office of the Register of Deeds in and for Hennepin County, Minnesota. We have examined title to the above described premises as shown by an Abstract of Title, last certified to January 23, 1969 at 7 :00 a.m. by Title Insurance Company of Minnesota. Based upon such examination, we are of the opinion that as of January 23, 1969 at 7 :00 a.m., the fee title to the above described tract was vested in DAISY G. JENSEN free and clear of all liens, charges and encumbrances except as follows: 1. A mortgage dated September 22, 1947, filed September 24, 1947 and recorded in Book 2299 of Mortgages, page 71, a mortgage dated July 2, 1948, filed July 8, 1948 and recorded in Book 2361 of Mortgages, page 144, a mort- gage dated August 10, 1953, filed August 10, 1953 and recorded in Book 2718 of Mortgages, page 271 and a mortgage dated November 1, 19541, filed November 3, 1954 and recorded in Book 2813 of Mortgages, page 229. Said mortgages were executed by marry C. Jensen and Daisy G. Jensen, husband and wife, in favor of Lutheran Brotherhood, a Minnesota corporation, to secure notes in the original principal amounts of $12,000, $1,504, $19,500 and $25,000 respectively. We require that these mortgages be satisfied and that the satisfaction of said mortgages be placed of record. 2. Real estate taxes payable in 1968 and prior years are paid. The real estate taxes payable in 1969 in the amount of $1,798.20 are unpaid. The buyer shall be allowed 10 days after receipt thereof for examination of said title and the making of any objections thereto, said objections to be made in writing or deemed to be waived. If any objections are so made the seller shall be allowed 120 days to make such title marketable. Pending correction of title the payments hereunder required shall be postponed, but upon correction of title and within 10 days after written notice to the buyer, the parties shall perform this agreement according to its terms. If said title is not marketable and is not made so within 120 days from the date of written objections thereto as above provided, this agreement shall be null and void, and neither principal shall be liable for damages hereunder to the other principal. All money there- tofore paid by the buyer shall be refunded. If the title to said property be found marketable or be so made within said time, and said buyer shall default in any of the agreements and continue in default for a period of 10 days, then and in that case the seller may terminate this contract and on such termination all the payments made upon this contract shall be retained by said seller and said agent, as their respective interests may appear, as liquidated damages, time being of the essence hereof. This provision shall not deprive either party of the right of enforcing the specific performance of this contract provided such contract shall not be terminated as aforesaid, and provided action to enforce such specific performance shall be commenced within six months after such right of action shall arise.
