EASEMENT FOR STORM SEWER

by and between The County of Hennepin, a body politic and
party of the first part, and the Village of Edina, a munic

corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said party of the first partl, in
rate,
consideration of One and No /100 (1.00) Dollars, to it in hard paid
by the said party of the second part, the receipt whereof is hereby
acknowledged, does Grant, Bargain, Sell, Convey, and Warranit to
said party of the second part an Easement in perpetuity forl storm
sewer purposes, including the right to enter for the purpose of
constructing, maintaining, altering, repairing, and reconstructing
a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota,
to -wit:
A strip of land, 10.00 feet in width, over and across
following described property:
That part of Tract D, Registered Land Survey Number 21 ,
files of the Registrar of Titles, County of Hennepin, nd
that part of the Northwest Quarter of the Southwest Qu rter,
Section 18, Township 28, Range 24, all described as fo lows:
Beginning at the point of intersection of the
Easterly line of said Tract D and the Northerly
right -of -way line of Eden Avenue; thence South-
westerly, along the Northerly right -of -way line
of Eden Avenue, a distance of 87.30 feet; thence
Northeasterly, deflecting to the right 112 degrees,
46 minutes, 17 seconds, a distance of 255.05 feet,
more or less, to the Southerly right -of -way line
of West 50th Street; thence Easterly, along said
Southerly right -of -way line, to its intersection
with the Northerly right -of -way line of said Eden
Avenue; thence Southwesterly, along said Northerly
right -of -way line, to the point of beginning.

The center line of said strip described as follows:
Commencing at the point of intersection of the
Easterly line of said Tract D with the Northerly
right -of -way line of said Eden Avenue; thence
Northeasterly along said right -of -way line a
distance of 18.60 feet to the point of beginning
of the centerline to be described; thence North-
westerly, deflecting to the left 116 degrees,
20 minutes, 00 seconds, a distance of 43.85 feet;
thence Northwesterly, deflecting to the right
29 degrees, 00 minutes, 00 seconds, a distance
of 153.50 feet, more or less, to the Westerly
line of the above described property, and said
center line there terminating. The side lines
of said strip shall extend or shorten to terminate
at the Westerly and Southerly lines of the above
described property.
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said storm sewer replace, at the expense of
party of the second part, any shrubs, sod, black top, curb
gutter removed by any excavation in connection with such construct-
ion or maintenance work, in as nearly as possible the same lcondition
as before such excavation.

This instrument is exempt from State deed tax.

IN TESTIMONY WHEREOF, the party of the first par
has caused these presents to be executed in its corporate name
by the chairman of its county board and its county auditor, clerk
of its county board, and the seal of said county auditor tc be
hereunto affixed the day and year first above written.
