THIS INSTRUMENT, Made this day of
1973, by and between The Church of Our Lady of Grace, in
Edina, Minnesota, a corporation under the laws of the State
of Minnesota, party of the first part, and the Village of
Edina, a municipal corporation organized under the laws of
the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part,
in consideration of One and no /100 Dollars ($1.00), to it in
hand -paid by the said party of the second part, the receipt
whereof is hereby acknowledged, does Grant, Bargain, Quitclaim
and Convey to said party of the second part an Easement in
perpetuity for sanitary sewer lift station, including the
right to enter for the purpose of constructing, maintaining,
altering, repairing and reconstructing said station in and
over the following described property situate in the County
of Hennepin and State of Minnesota, to -wit:
All that part of Government Lot 8, in Section 28,
Township 117 North, Range 21 West, of the Fifth
Principal Meridian, according to the Government
Survey thereof bounded and described as follows:
Beginning at a point on the South line of Eden
Avenue, which point is 290 feet Northeasterly,
as measured along said South line of Eden Avenue,
from the East right -of -way line of the Minneapolis,
Northfield and Southern Railroad; thence South-
easterly, at right angles to said South line of
Eden Avenue, a distance of 20 feet; thence North-
easterly, parallel with said South line of Eden
Avenue to the Westerly right -of -way line of
Minnesota State Highway No. 100; thence North -
westerly along said Westerly right -of -way line to
the South line of Eden Avenue; thence Southwesterly
along said South line of Eden Avenue to the point
of beginning.
It is the intention and agreement of the parties
hereto that the party of the second part shall in the
construction, or maintenance of said sanitary sewer lift
station replace any shrubs or sod removed by any excavation
in connection with such construction or maintenance work
in as nearly as possible the same condition as before such
excavation.

personally appeared Joseph L. Baglio and Arnold Madigan,
to me personally known, who, being each by me duly sworn,
did say that they are respectively the Vice President and
the Secretary of the corporation named in the foregoing
instrument and that the seal affixed to said instrument is
the corporate seal of said corporation, and that said
instrument was signed and sealed in behAlf of said corporation
by authority of its Board of Directors and said Joseph L.
Baglio and Arnold Madigan acknowledged said instrument to
be the free act and deed of said corporation.
