Smith husband 1kn8 wife of the CoGGuiinttyy of Hennepin and State of Minnesota, parties of the first part, and the c of Edina, a municipal corporation organized under the laws of the State of Minnesota, party of the second part; WITNESSETH, That the said parties of the first part, in considera- tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to said party of the second part an Easement in perpetuity for sanitary sewer purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing a sanitary sewer system in and over the following described property situate in the County of Hennepin and State of Minnesota, to -wit: That part of Lot 30 Brookside Terrace lying East of the West 111 feet thereof lying within a 15 foot easement, the centerline of which is' described as followns Commencing at a point on the centerline of vacated Motor Street which point is 23.72 feet East of the intersection of the Southerly exten- sion of the West line of Lot 2, Block 4, Arden Mark 3rd Addition with said centerline of Motor Strestt thence Southwesterly, at a deflection angle to the left of 86%p271310 as turned from the centerline of Motor Street, a distance of 53.5 foett thence Southwesterly at a deflection angle to the right of 3603813600 a distance of 164.31 feetr thence Southeasterly, at a deflection angle to the left of 48*14605 ", a dis- tance of 98.1 feet# thence Southeasterly, at a deflection angle to the left of 25 23115 ", a distance of 71.1 feett thence Southeasterly at a deflection angle to the left of 24021130 ", a distance of 71.1 feett thence Southwesterly at a deflection angle to the right of 660031550, a distance of 54.8 feett thence Southeasterly at a deflection angle to the left of 27 3110 a distance of 8862 feett thence Southeasterly at a deflection angle to the right of 6 091, a distance of 164.0 feet and there terminating. Also a temporary construction easement lying 10 feet on all sides of and abutting the above described permanent easement. Said temporary easement shall terminate on July 1, 1975. This instrument was drafted by City of Edina 4801 Nest 50th Street Edina, Minnesota 55424 This instrument is exempt from State Deed Tax. .T . .0. It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said sanitary sewer replace any shrubs or sod removed by any excavation in connection with such construction or maintenance work, in as nearly as possible the same condition as before such excavation.
