EASEMT FOR SANITARY SEWER

and State of Minnesota, parties of the first part, and the Vtblxgx of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey and Warrant to said party of the second part an Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to wit:
That part of the North 68 feet of that part of Lot 31, Brookside
Terrace lying Bast of the West 111 feet thereof, lying within a
15 foot easement, the centerline of which is described as followss
Commencing at a point on the centerline of vacated motor street which
point is 23,72 feet East of the intersection of the Southerly exten-
sion of the West line of Lot 2, Block 40 Arden Park 3rd Addition, with
said centerline of Motor Streett thence Southwesterly, at a deflection
angle to the left of 86 027031" as turned from the centerline of Motor
Street, a distance of 53.5 feet] thence Southwesterly at a deflection
angle to the right of 36 °36'36", a distance of 164.31 feat= thence
Southeasterly, at a deflection angle to the left of 48 0141050, a dis-
tance of 90.1 feetr thence Southeasterly, at a deflection angle to the
left of 25023'15', a distance of 71.1 feet= thence Southeasterly at a
deflection angle to the left of 24021'30", a distance of 71,1 feett
thence Southwesterly at a deflection angle to the right of 66 °03'.55",
a distance of 54.$ feetr thence Southeasterly at a deflection =910
to the left of 27 311, a distance of 88.2 feett thence Southeasterly
at a deflection angle to the right of 60091, a distance of 164.0 feet
and there tersainating.
Also a temporary construction easement lying 10 feet on all sides of
and abutting the alcove described permanent easement. Said temporary
easement shall terminate on July 1, 19750

It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
IN WITNESS WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year first abeve written.
