THIS INSTRUMENT, Made this A day of 19 74 y
by and between Daryl D. Sorem and Mildred H. Sorem, husband and wife
of the County of Hennepin and State
of Minnesota, parties of the first part, and the City of Edina, a municipal
corporation organized under the laws of the State of Minnesota, party of the
second part;
WITNESSETH, That the said parties of the first part, in consideration
of One and N0 1100 Dollars ($1.00), to them in hand paid by the said party of
the second part, the receipt whereof is hereby acknowledged, do Grant, Bargain,
Sell, Convey and Warrant to said party of the second part an Easement in per-
petuity for all utility and drainage purposes including, but not being limited
to, sanitary sewer, storm sewer, water pipes, including the right to enter for
the purpose of constructing, maintaining, altering, repairing and reconstruct-
ing said utility and drainage systems in and over the following described pro-
perty situate in the County of Hennepin and State of Minnesota, to -wit:
The North twenty feet (20') and the West ten feet (10').of that
part of the South 1/2 of vacated West 57th Street lying North
of and adjacent to Lot 1, Block 3, Melody Knolls 3rd Addition.
It is the intention and agreement of the Parties hereto that the
party of the second part shall in the construction, or maintenance of said
utility and drainage systems replace any shrubs or sod removed by any excava-
tion in connection with such construction or maintenance work, in as nearly as
possible the same condition as before such excavation.
This instrument is exempt from State Deed Tax.
IN WITNESS WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year f,4st above written
