THIS INSTRUMENT, Made this 12th day of June , to 74,
by and between Fa Aview Community Hospitu" ,
a corporation under the laws of the State of Minnesota, party of the
first part, and the City of Edina, a municipal corporation organized
under the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in con-
sideration of One and No /100 Dollars ($1.00), to it in hand paid by
the said party of the second part, the receipt whereof is hereby
acknowledged, does Grant, Bargain, Sell, Convey and Warrant to said
party of the second part an Easement in perpetuity for sanitary
sewer purposes, including the right to enter for the purpose of con-
structing, maintaining, altering, repairing and reconstructing a
sanitary sewer system in and over the following described property
situate in the County of Hennepin and State of Minnesota, to -wits
That part of Lot 2, Cassin's Ontlots described as followsa
Beginning at a point on the North line of Tract A, Registered
Land Survey No. 1234, which point is 68 feet East of the center-
line of County Road No. 17 (France Avenue); thence North, at
right angles to said North line of Tract A, a distance of 10
feet; thence East, 10 feet North of and parallel with said
north line of Tract A, to the Southwesterly line of West 65th
Street; thence Southeasterly along the Southwesterly line of
West 65th Street to the North line of said Tract A; thence
West along said North line of Tract A, R.L.S. No. 1234 to the
point of beginning.
Also a temporary construction easement over that part of Lot 2,
Cassin's Outlots Lying North and West of the above described
permanent easement and South of the South line of West 65th
Street. Said temporary construction easement shall terminate
on December 31, 1974.

This instrument is exempt from the State Deed Tax , DIVISION
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction or main-
tenance of said sanitary sewer replace any shrubs or sod removed by
any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
