EASEMENT FOR SANITARY SEWER
THIS 1A45TRIPMENT, made this day of , 1974, by
and bets, wen THOMAS E. ERICKSON and CHAUES T.7. ERICKSOP,, as Executors of the
East Will and Testament of Joseph E. Erickson, deceaseJ, parties of the .
first part, and the City of Edina, a municipal corporation organized
under the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of 0-ne ($1.00) Dollar to them in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, do Grant, Bargain,
Sell, Convey and Warrant to said party of the second part an Easement in
perpetuity for sanitary sewer purposes, including the right to enter for
the purpose of constructing, maintaining, altering, repairing and recon-
structing a sanitary sewer system in and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
That part of Outlot 2, SOLTHDALE OFFICE PARK, lying
within a 20 foot wide strip of land, the centerline
of which if; described as follows:
Beginning at a point- on the North line of said Outlot
2, which point is 256.35 feet west of the Northeast corner
of said Outlot 2 when measured along, said North line;
thence southwesterly at an interior angle of 106° and
5" as turned from the Northeast corner of said Outlot
2, a distance of 146.5 feet, and there terminating.
Also temporary construction easements 10 feet in width
lying easterly and westerly of and abutting the above
described permanent easement, which temporary easements
shall terminate on December 31, 1974.
It is the intention and agreement of the Parties hereto that the
party of the second part shall in the construction or maintenance of said
sanitary sewer repla-e any shrubs or sod removed by any excavation in con-
nection orith such construction or maintenance pork, in as nearly as possible
the same condition as before such excavation.
IN TESTIZIONY WHEREOF, the said parties of the first part have
caused these presents to be duly executed the day and year first above
written.
