Said permanent utility easement being 20 feet on both sides of the following described centerline. KINNEY Re: Edina West Condominiums - Easement Encroachment Dear Mr. Erickson: In accordance with our telephone conversation of last week enclosed is a photocopy of Mortgage Loan Survey prepared by BRW which shows The Edina West Condominium project. You will note from the survey and detail "A" that Building No. IV encroaches upon the 40 foot sewer easement at its northwest corner. Detail "A" indicates that the encroachment is very slight. I would suspect that it does not interfere with the easement in favor of the City of Edina for sewer and water. I would hope that this problem could be remedied simply by having the City of Edina release from its easement that portion of the 40 foot strip which is encroached upon by Building No. IV. Before this problem can be finally remedied I realize that you will have to have the exact legal description of that portion of the building which encroaches upon the easement and also information concerning establishment the t blishment of the easement. IC However, I thought that in order to expedite this matter as much as possible I would send to you at this time the survey which shows the problem with which we are dealing. As soon as I obtain a certified survey with the correct legal description of the encroaching portion of the building I will forward that to you together with the information concerning the establishment of the easement. • BRIGGS AtiD MORGA.N Mr. Thomas Erickson October 12, 1976 Page 2 As we discussed by telephone, I assume that if the easement were created by deed, the city would simply be able to quit claim back to Edina West that portion of the strip which the building encroaches upon. If the easement were created by plat dedication it may be necessary that the dedication for sewer and water be partially vacated.
